Resolución N° 2540 - Modificatoria de la Resolución N° 2310 "Reglamento Técnico Andino para el Etiquetado de Productos Cosméticos" (Resolution No. 2540 amending Resolution No. 2310 "Andean Technical Regulation on the labelling of cosmetic products")

The Republic of Ecuador, on behalf of the Plurinational State of Bolivia, the Republic of Colombia, and Peru, as member countries of the Andean Community, hereby notifies the issuance of Resolution No. 2540, which amends Resolution No. 2310. This amendment responds to the trade facilitation needs expressed by the industry and interested parties. It introduces greater flexibility regarding the use of supplementary stickers or labels, allowing for the inclusion or clarification of information and making it possible to modify or cover information on the original label, providing that the definition of a cosmetic product is respected and that compliance with Article 3 of Decision No. 833 is maintained. It also updates the labelling requirements, permitting the use of the word "ingredients" or equivalent terms. Among other minor adjustments that relax certain requirements included in the original version of Resolution No. 2310, the text clarifies that changes that do not involve sanitary or regulatory aspects do not need to be notified to the competent authority. Lastly it relaxes the Spanish translation requirement for the generic name of a cosmetic product when the name in its original language is commonly used and generally understood to identify a specific range of products with a clearly known purpose. These changes reflect the Andean Community's commitment to regulatory harmonization, transparency and trade facilitation, while ensuring the safety and quality of cosmetic products in the region. __________
