The use of bitter orange extract as feed additive was authorised for certain animal species by Commission Implementing Regulation (EU) 2022/652. Bitter orange extract is known to contain 10 to 20% neohesperidin, as detailed in the column "Composition, chemical formula, description, analytical method" in the Annex to Implementing Regulation (EU) 2022/652. An incorrect presumption of a relationship between neohesperidin, identified with CAS number 13241-33-3, and neohesperidin dihydrochalcone, identified with CAS number 20702-77-6, which has a similar name but is a distinct substance, resulted in point 3 of the column "Other provisions" in the Annex to Implementing Regulation (EU) 2022/652, which mistakenly provides for the exclusion of the use of bitter orange extract in combination with neohesperidin dihydrochalcone. Commission Implementing Regulation  (EU) 2023/54 corrects this mistake.

Kazakhstan notified, in G/SPS/N/KAZ/74 (dated 23 October 2020) and G/SPS/N/KAZ/97 (dated 6 December 2021 г.), the Letter of the Committee for Veterinary Control and Surveillance of the Ministry of Agriculture of Kazakhstan on the introduction of temporary restrictions on the importation into the territory of Kazakhstan from Saratov, Tyumen, Kurgan regions and the Republic of Bashkortostan of Russian Federation of live poultry and hatching eggs, down and feathers, poultry meat and all types of poultry products that have not undergone heat treatment (at least 70 °C), feed and feed additives for birds (except for feed additives of plant origin, chemical and microbiological synthesis), hunting trophies that have not undergone taxidermic treatment (feathered game), as well as used equipment for keeping, slaughtering and butchering birds.The notified measure was modified by the Letter of the Committee for Veterinary Control and Surveillance of the Ministry of Agriculture of Kazakhstan.

The notified text resolves as follows: ARTICLE 1 - PURPOSE To implement paragraph 3 of Constitutional Court Judgment T-343 of 2022 concerning the adoption of administrative measures necessary to suspend immediately the marketing of agricultural chemicals with the component Chlorpyrifos. ARTICLE 2 - SUSPENSION OF MARKETING To suspend immediately the marketing in the national territory of chemical products for agricultural and livestock use that contain Chlorpyrifos. ARTICLE 3 - CANCELLATION OF REGISTRATIONS To cancel the ICA registrations of chemical products for agricultural and livestock use that contain Chlorpyrifos. ARTICLE 4 - PROHIBITION OF IMPORTATION To prohibit immediately the importation of raw materials and finished goods for marketing in the national territory, of chemical products for agricultural and livestock use use that contain Chlorpyrifos. ARTICLE 5 - DENIAL AND REJECTION OF APPLICATIONS To deny and reject immediately registration procedures of chemical products for agricultural and livestock use containing Chlorpyrifos, including modification procedures. ARTICLE 6 - DEFINITIVE ELIMINATION Within a maximum period of six (6) months from the notification of Judgment T-343 of 2022, the ICA shall adopt additional administrative measures to those established in this Resolution, aimed at the definitive elimination of the use in the national territory of agricultural and livestock chemical products containing Chlorpyrifos. ARTICLE 7 - SANCTIONS Failure to comply with any of the provisions established in this Resolution shall be sanctioned in accordance with the provisions of Articles 156 and 157 of Law 1955 of 2019, without prejudice to any civil and criminal actions that may be applicable.

The Committee for Veterinary Control and Surveillance of the Ministry of Agriculture of Kazakhstan reports that on the basis of the official notification of the World Organisation for Animal Health (WOAH), an outbreak of highly pathogenic avian influenza virus (HPAI) was registered in the Denizli region of Türkiye. In this regard, since 10 March 2023, temporary restrictions have been introduced on the importation to the territory of Kazakhstan from the Denizli region of Türkiye of live poultry and hatching eggs, down and feathers, poultry meat and all types of poultry products that have not undergone heat treatment (at least 70 °C), feed and feed additives for birds (except for feed additives of chemical and microbiological synthesis), hunting trophies that have not undergone taxidermic treatment (feathered game), the former used equipment for keeping, slaughtering and butchering birds susceptible to highly pathogenic avian influenza virus (HPAI), as well as transit through the territory of Kazakhstan of live birds susceptible to highly pathogenic avian influenza virus (HPAI). With regard to the above goods shipped before 10 March 2023, the decision to let them pass is made in the usual manner.

In this regard, since 30 March 2023, temporary restrictions have been introduced on the importation to the territory of Kazakhstan from the territories of England, Scotland and Wales of the United Kingdom of Great Britain of live poultry and hatching eggs, down and feathers, poultry meat and all types of poultry products that have not undergone heat treatment (at least 70 °C), feed and feed additives for birds (except for feed additives of chemical and microbiological synthesis), hunting trophies that have not undergone taxidermic treatment (feathered game), the former used equipment for keeping, slaughtering and butchering birds susceptible to highly pathogenic avian influenza virus (HPAI), as well as transit through the territory of Kazakhstan of live birds susceptible to highly pathogenic avian influenza virus (HPAI). With regard to the above goods shipped before 30 March 2023, the decision to let them pass is made in the usual manner.

In this regard, since 28 March 2023, temporary restrictions have been introduced on the importation to the territory of Kazakhstan from the territories of Rhineland-Palatinate and Schleswig-Holstein of Germany of live poultry and hatching eggs, down and feathers, poultry meat and all types of poultry products that have not undergone heat treatment (at least 70 °C), feed and feed additives for birds (except for feed additives of chemical and microbiological synthesis), hunting trophies that have not undergone taxidermic treatment (feathered game), the former used equipment for keeping, slaughtering and butchering birds susceptible to highly pathogenic avian influenza virus (HPAI), as well as transit through the territory of Kazakhstan of live birds susceptible to highly pathogenic avian influenza virus (HPAI). With regard to the above goods shipped before 28 March 2023, the decision to let them pass is made in the usual manner.

In this regard, since 28 March 2023, temporary restrictions have been introduced on the importation to the territory of Kazakhstan from the territory of the Republic of Moldova of live poultry and hatching eggs, poultry meat and all types of poultry products that have not undergone heat treatment (at least 70 °C), feed and feed additives for birds (with the exception of feed additives of plant origin, chemical and microbiological synthesis), as well as used equipment for keeping, slaughtering and butchering birds susceptible to Newcastle disease, as well as transit through the territory of Kazakhstan of live birds susceptible to Newcastle disease. With regard to the above goods shipped before 28 March, 2023, the decision to let them pass is made in the usual manner.
