The Agreement regulates certification of raw coniferous and non-coniferous wood packaging material with a view to controlling quarantine pests associated therewith, and establishes rules for the registration of natural and legal persons that treat raw wood packaging material used in international trade. The Agreement does not cover wood packaging manufactured entirely from wood products such as plywood, particle board, oriented strand board or veneer sheets manufactured using glue, heat and pressure or a combination thereof. Nor does it cover wood packaging such as veneer peeler cores (by-products of veneer production), sawdust, wood chips (raw or thinly cut to a thickness of less than six millimetres), wood wool. EPA is proposing to revoke 34 exemptions from the requirement of a tolerance that are associated with 31 inert ingredients because these substances are no longer contained in active Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) pesticide product registrations. These ingredients are subject to reassessment by August 2006 under section 408(q) of the Federal Food, Drug, and Cosmetic Act (FFDCA), as amended by the Food Quality Protection Act of 1996 (FQPA). Upon the issuance of the final rule revoking the tolerance exemptions, the 34 tolerance exemptions will be counted as "reassessed'' for purposes of FFDCA's section 408(q).

EPA proposed to add this chemical category to the EPCRA section 313 toxic chemical list pursuant to its authority to add chemicals and chemical categories because EPA believes this category meets the EPCRA section 313(d)(2)(B) toxicity criterion. The purpose of today's action is to inform interested parties that, in an effort to ensure adequate opportunities for input from all affected parties, EPA is making available for public comment a revised hazard assessment for DINP.
