Regulations amending the Fertilizers Regulations

The Canadian Food Inspection Agency (CFIA) has published the final regulations amending the Fertilizers Regulations on 11 November 2020. The amendments introduce a risk-based approach, strengthen regulatory controls for product safety, environmental sustainability and consumer protection while reducing regulatory and administrative burden on regulated parties. These regulations were previously notified in G/TBT/N/CAN/571. The regulatory changes to the Fertilizers Regulations:  Update product definitions and the compositional criteria of primary materials to bring them up to date with current science, industry trends and international standards; Use incorporation by reference to enable regular updates to the List of Materials as new information comes to light; Clarify the general exemptions from all provisions of the Fertilizers Act and the Regulations to facilitate the import of products intended for export or manufacturing purposes; Introduce a risk-based approach to support innovation and expedite time to market for safe fertilizers and supplements, while maintaining high product safety standards; Align regulatory intervention and oversight with the potential health and safety risks associated with the product and its use (revised exemptions from registration); Reduce regulatory and administrative burden on regulated parties by streamlining the registration, re-registration and registration amendment process; and Modernize labelling requirements to allow more flexibility and limit the mandatory label information. All required information will have to appear in both official languages. The amendments contain transitional provisions that allow regulated parties to comply with either the "new" regulations or the "old" regulations for a period of three years. This applies to the manufacture, sale, import or export of fertilizers and supplements regulated under the Fertilizers Act. Combining provisions from "new" and "old" regulations is not permitted. Product proponents must comply with either "new" or "old" regulations with respect to a single product.
